The National S’mores Day Giveaway (the "Giveaway") is open to all legal residents of the fifty (50) United States or the District of Columbia and are at least twenty-five (25) years old at the time of entry. Employees of City Bonfires or any company associated with the promotion of the Giveaway and their respective immediate families (spouse, parents, siblings, and children) and household members are not eligible.

The Giveaway is sponsored by City Bonfires (the “Sponsor”), located at City Bonfires, 891I Rockville Pike Ste 119 Rockville, MD 20852, United States of America. This giveaway is not sponsored, endorsed, or administered by, or associated with Instagram, Facebook or Meta.

Participation in the Giveaway constitutes the entrant's full and unconditional agreement to and acceptance of these Official Giveaway Rules and the decisions of the Sponsor, which are final and binding.

The Giveaway begins on Friday, July 22 at 10:00 AM EST and ends on Wednesday, August 10th at 11:59 PM EST (the "Giveaway Period"). Entries that are submitted before or after the Giveaway Period will be disqualified.

*Alternative entries must be received by August 10th, 2022 at 10:00 AM EST. Limit one (1) mail-in entry per person for the duration of the Giveaway Period. Entries received from any person in excess of the stated limitation will be void. All entries become the property of the Sponsor and may not be acknowledged or returned.

On or about Wednesday, August 11th, 2022, at 12:00 PM (Noon) EST, one or more entities working on behalf of the Sponsor will randomly select the potential winner from among all eligible entries received. The odds of being selected depend on the number of entries received. The Sponsor will attempt to notify the potential winner via direct message on Instagram and/or Facebook, email, or telephone on or about Wednesday, August 11th, 2022. If the potential winner cannot be contacted within five (5) days after the date of the first attempt to contact him/her/them, the Sponsor may select an alternate potential winner from among the remaining eligible entries. The winner(s) of the Giveaway will receive: An RV Share rental gift card valued at $750; KOA gift card valued at $500; Camco prize package valued at $250; a TravelWifi hotspot with data valued at $200; City Bonfire S’mores Night Family Packs valued at $120. Prize value totals $1,820.

Prize retail value may differ at the time of award. The specifics of the prize(s) will be solely determined by City Bonfires. No cash or other prize substitution(s) will be permitted. All prizes are non-transferable and subject to income tax. Any and all prize-related expenses, including without limitation, any and all federal, state, and/or local income taxes, shall be the sole responsibility of the winner. Acceptance of a prize constitutes permission for City Bonfires to use a winner’s name, likeness and entry for purposes of advertising and promotion without further compensation, unless prohibited by law.

The potential winner(s) will be notified by direct message on Instagram and/or Facebook, email, phone, or in person. If a potential winner cannot be contacted, is ineligible, or fails to claim the prize within ten (10) days from the time award notification was sent, the potential winner forfeits the prize. Potential winners must continue to comply with all terms and conditions of these Official Giveaway Rules, and winning is contingent upon fulfilling all requirements. In the event that a potential winner is disqualified for any reason, the Sponsor will award the applicable prize to an alternate winner from among the remaining eligible entries. Only three (3) alternate selections will be held, after which time a prize will not be awarded.

In the event that the operation, security, or administration of the Giveaway is impaired in any way for any reason including, but not limited to fraud, virus, bug, worm, unauthorized human intervention, or other technical problem; or in the event the Giveaway is unable to run as planned for any other reason, as determined by Sponsor in its sole discretion, the Sponsor may, in its sole discretion, either (a) suspend the Giveaway to address the impairment and then resume the Giveaway in a manner that best conforms to the spirit of these Official Giveaway Rules, or (b) terminate the Giveaway and, in the event of termination, award the prize from among the eligible, non-suspect entries received up to the time of the impairment.

The Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Giveaway, or to be acting in violation of these Official Giveaway Rules or in an unsportsmanlike or disruptive manner. Any attempt by any person to damage the website or undermine the legitimate operation of the Giveaway may be a violation of criminal and civil law, and, should such an attempt be made, the Sponsor reserves the right to seek damages (including attorney's fees) and any other remedies from any such person to the fullest extent permitted by law. Failure by the Sponsor to enforce any provision of these Official Giveaway Rules shall not constitute a waiver of that provision.

Participants attest that they are the sole copyright owner of all recipes, stories of favorite s’more memories, photos or videos shared with City Bonfires. Participants retain the rights to their photograph, stories, videos and any other content shared as part of this Giveaway; however, by entering the Giveaway, they grant City Bonfires (and those authorized by City Bonfires) a royalty-free, world-wide, perpetual, non-exclusive license to publicly display, distribute, reproduce and create derivative works of the entries, in whole or in part, in any media now existing or later developed, for any purpose, including, but not limited to, advertising and, promotion institution publications. Any photograph reproduced will include a photographer credit as feasible. City Bonfires will not be required to pay any additional consideration or seek any additional approval in connection with such uses.

By participating in the Giveaway, entrants agree to release and hold harmless City Bonfires, its affiliated or related entities, and their employees, agents, volunteers, contractors, successors and assigns, as well as any other entities associated with the Giveaway and each of their respective officers, directors, employees, shareholders, representatives, and agents (collectively, the “Released Parties”) from and against any claim or cause of action arising out of participation in the Giveaway or receipt or use of the prize (including any travel or activity related thereto) including, but not limited to: (a) any technical errors associated with the Giveaway, including lost, interrupted or unavailable Internet Service Provider (ISP), network, server, wireless service provider, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone, cellular tower or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties; (b) unauthorized human intervention in the Giveaway; (c) mechanical, network, electronic, computer, human, printing, or typographical errors; (d) application downloads, (e) any other errors or problems in connection with the Giveaway, including, without limitation, errors that may occur in the administration of the Giveaway, the announcement of the winner, the cancellation or postponement of the event and/or the flyover, if applicable, the incorrect downloading of the application, the processing of entries application downloads or in any Giveaway-related materials; or (f) injury, death, losses or damages of any kind, to persons or property which may be caused, directly or indirectly, in whole or in part, from entrants participation in the Giveaway or acceptance, receipt or misuse of the prize (including any travel or activity related thereto). The Released Parties are not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Giveaway. The entrant waives the right to claim any and all damages, including, but not limited to, punitive, consequential, direct, or indirect damages. Nothing herein shall serve as a waiver of sovereign immunity by any of the Released Parties to whom sovereign immunity may be available nor shall anything herein be construed as consent by any of the Released Parties to be sued by any entrant or any other third party. By entering, you agree with Facebook and Instagram's terms of use, and you release Facebook and Instagram of any responsibility.

Except where prohibited, each entrant agrees that any and all disputes, claims and causes of action arising out of, or connected with the Giveaway, or any prize awarded, shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in Maryland. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Giveaway Rules, entrants rights and obligations, or the rights and obligations of the Sponsor in connection with the Giveaway, shall be governed by, and construed in accordance with the laws of the State of Maryland, without giving effect to any choice of law or conflict of law rules, which would cause the application of the laws of any jurisdiction other than Maryland.
